RBI guidelines ensure multilingual customer communication and a quicker grievance redressal by banks

  • Reserve Bank of India (RBI) has, from time to time, emphasised that banks must communicate with customers in their preferred language to ensure clarity and convenience. RBI’s Master Circular on Customer Service in Banks states, inter alia, that all customer-facing materials at the branches of Scheduled Commercial Banks must be made available in Hindi, English, and the concerned regional language. Further, RBI vide its letter dated September 30, 2024, reiterated that all communications to customers, should invariably be issued in a trilingual format-Hindi, English, and the regional language. All Banks have a robust board approved grievance redressal mechanism in place to address complaints. Further, the Reserve Bank – Integrated Ombudsman Scheme (RB-IOS), 2021, provides a cost-free platform for redressal of complaints against RBI-regulated entities (REs) in matters relating to deficiency in service, if the grievance is not redressed or reply is not given by the RE within the prescribed timeline.

Advisory –System Enhancement for Order-Based Refunds

  • 1. As per the available functionality, taxpayers could claim refunds under the category “On account of Assessment/Enforcement/Appeal/Revision/Any Other Order” (ASSORD) only if:
  • The cumulative amount of the Demand ID showed a negative balance (i.e., refund eligible).
  • The status of the Demand ID was “Refund Due”.

This restriction prevented taxpayers from claiming refunds when individual components (minor heads) of a demand showed negative balances and the overall cumulative balance was zero or positive

2. For the above scenario, several references have been made by the tax payers and tax officers stating that the taxpayers are not able to claim the refund. Accordingly the following changes have been implemented in the system:

  • Refunds can now be claimed irrespective of the Demand ID status.
  • Refunds are allowed even when the cumulative balance is positive or zero, provided any minor head has a negative balance.
  • Only negative balances will be auto-populated in the refund application (Form RFD-01); taxpayers cannot claim any refund for the positive amounts within the demand.
  • Order Number Suggestions: The system automatically suggests the most recent demand order associated with a negative balance such as order-in-original, rectification order or appellate order etc.

Tooltips: Clear guidance is provided near the Order No. and Demand ID fields to help taxpayers enter the correct details.

4.A comprehensive user manual and FAQs will be shared shortly. In case of any discrepancies or system-related queries, a ticket may be raised with the GST helpdesk.

IBBI Discussion Paper on Proposed Amendments to CIRP Regulations

The Insolvency and Bankruptcy Board of India (IBBI) released a Discussion Paper dated 06th August 2025 proposing amendments to the IBBI (Corporate Insolvency Resolution Process) Regulations, 2016.

The key recommendations are as follows:

Recording of CoC’s deliberation on RA’s eligibility under section 29A

IBBI Discussion paper on Review of Limit on Number of Assignments being handled by IPs

The IBBI has released a discussion paper dated 12th August 2025 proposing a revision of the limits on assignments handled by Insolvency Professionals (IPs). Currently, an IP can act as Resolution Professional (RP) in up to ten CIRP cases, but there is no cap on roles as Interim Resolution Professional (IRP) or Liquidator, leading to concentration of work among a few IPs and delays in processes. To address this, the Board proposes a combined ceiling of ten assignments across RP, IRP, and Liquidator roles, with not more than three assignments involving claims above ₹1000 crores.

Hence the amendment proposed by IBBI is “An IP shall not have more than 10 assignments in aggregate as IRP, RP in CIRP, and Liquidator, with not more than 3 assignments involving admitted claims exceeding ₹1000 crores”.

  • Bankruptcy Board of India (IBBI) has notified amendments to the Continuing Professional Education (CPE) Guidelines, 2019 on 13th August 2025 to strengthen professional development for Insolvency Professionals (IPs). The annual CPE requirement has been increased from 10 hours to 30 hours per year, while the earlier rolling block requirement of 60 hours in three years has been removed. A phased mandate for in-person learning has been introduced, requiring 40% of credits through in-person programs from 2026, 50% from 2027, and 60% from 2028 onwards. IPs must now also seek prior approval from their respective Insolvency Professional Agency before enrolling in CPE programs conducted by entities other than IBBI or IPAs. Additionally, new subject areas such as the Prevention of Money Laundering Act (PMLA) and fraud detection have been included for CPE. These changes aim to ensure higher standards of competence, ethics, and continuous professional growth for IPs.

THE INSOLVENCY AND BANKRUPTCY CODE (AMENDMENT) BILL, 2025

The Insolvency and Bankruptcy Code (Amendment) Bill, 2025 (Bill No. 107 of 2025) was introduced in Lok Sabha on 12 August 2025 and it has been referred to a Select Committee of Parliament for detailed review. The IBC Amendment Bill, 2025 is currently under examination by a Select Committee in Parliament.

They seek to modify existing provisions to better align with the overall objectives of the Code and to introduce new provisions that follow global best practices for resolving insolvency. The proposed legislation introduces a “creditor-initiated insolvency resolution process” with an out-of-court initiation mechanism for genuine business failures to facilitate faster and more cost-effective insolvency resolution, with minimal business disruption. The proposed legislation also introduces provisions for “group insolvency” and “cross-border insolvency”.
